DOC INCORPORATED
Terms of Service
Effective date: September 10, 2026 · Last updated: October 5, 2026
These Terms of Service ("Terms") govern your use of the websites, software, applications, and services provided by Doc Incorporated ("Doc Incorporated," "we," "us," or "our"), including DocMarketing (collectively, the "Services"). They apply to current and future Services that reference these Terms. Product-specific terms or a separate written agreement may supplement these Terms and control in the event of a conflict for that product.
1. Acceptance and eligibility
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services. You must be legally able to enter into an agreement and meet any age requirements of the Service and connected platforms. If you act for a business or another organization, you represent that you have authority to bind it to these Terms.
2. Accounts and your responsibilities
You are responsible for providing accurate account information, protecting your login credentials, and activity you authorize through your account. Only connect accounts you own or are authorized to manage. Notify us if you believe your account has been accessed without permission.
3. DocMarketing and AI-assisted content
DocMarketing is a web application that may generate marketing drafts using artificial intelligence and let you review, edit, approve, and schedule content. Features and integrations may vary or change over time.
AI-generated material may be inaccurate, incomplete, inappropriate, or similar to material generated for others. You are responsible for reviewing drafts before approving or using them, including checking facts, advertising claims, required disclosures, permissions, and compliance with applicable laws and platform rules. We do not guarantee the accuracy, originality, legal suitability, audience reach, or performance of generated content.
Media is uploaded to a connected platform only when you choose or approve that upload. When you approve a scheduled post, you authorize the upload and publishing actions needed to carry out that schedule, subject to the platform's rules and available features. Scheduling does not guarantee publication at an exact time or acceptance by a platform.
4. Connected platforms and service providers
The Services may connect to TikTok, YouTube, Facebook, Instagram, or other third-party platforms through official APIs. Connecting an account authorizes the permissions shown in the platform's authorization process, such as access to basic account/profile information needed for authentication and publishing. You can revoke access through the connected platform's account or application settings; doing so may prevent related features or scheduled posts from working.
Third-party services are governed by their own terms and privacy policies. If you use a YouTube integration, you also agree to the YouTube Terms of Service. Platforms may restrict, change, or discontinue API access, remove content, or suspend accounts. We do not control their availability or decisions. The Services may also rely on hosting, AI, analytics, payment, and other service providers.
5. Acceptable use
You must use the Services lawfully and responsibly. You may not:
- Publish unlawful, fraudulent, misleading, infringing, harassing, or otherwise prohibited content, or violate another person's privacy or rights.
- Upload content, music, images, likenesses, or other materials without the rights or permissions needed for your intended use.
- Send spam, impersonate others deceptively, manipulate engagement, or bypass platform permissions, safeguards, or usage limits.
- Introduce malicious code, interfere with the Services, access systems or accounts without authorization, or attempt to obtain other users' data.
6. Content and intellectual property
You retain any rights you hold in content you provide. You grant Doc Incorporated permission to host, store, copy, process, adapt, and transmit that content only as needed to operate and provide the Services you use, including generating drafts and carrying out your approved uploads or publishing instructions. This permission does not transfer ownership of your content to us.
Doc Incorporated and its licensors retain their rights in the Services, software, branding, and other materials we provide. Subject to these Terms, you may use the Services for their intended purposes. Rights in AI-generated output depend on applicable law and relevant provider terms; these Terms do not promise exclusive rights or copyright protection for that output.
7. Fees and payments
If you choose a paid Service, the applicable price, billing frequency, renewal terms, and cancellation terms will be disclosed when you purchase it. You are responsible for agreed charges and applicable taxes. Any refund rights required by law remain available.
8. Privacy
Our Privacy Policy explains how we handle information in connection with the Services, including connected account information and uploaded content. Doc Incorporated does not sell user data.
8A. SMS Messaging Terms
Huckleberry's Diesel Services LLC may offer optional SMS messaging for service-related communications, including scheduling, appointment reminders, job status updates, estimates, parts availability, and customer support. Consent to receive SMS messages is voluntary and is not a condition of purchasing goods or services, creating an account, or completing a transaction.
Message frequency varies. Message and data rates may apply. Reply STOP at any time to opt out. Reply HELP for help, or contact support@docincorporatedllc.com. Carriers are not liable for delayed or undelivered messages.
Your SMS consent applies only to the specific messaging program for which you opted in and is not transferred or shared with third parties or affiliates for their marketing or promotional purposes. See our Privacy Policy and SMS Messaging Program for more information.
9. Disclaimers
To the extent permitted by law, the Services are provided "as is" and "as available," without warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation, that every defect will be corrected, or any particular business result. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.
10. Limitation of liability
To the maximum extent permitted by law, Doc Incorporated will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, goodwill, or data arising from or related to your use of the Services. These limitations apply only where lawful and do not limit liability that cannot be excluded or limited under applicable law.
11. Suspension and termination
You may stop using the Services at any time and contact us to request account closure. We may suspend or terminate access for violations of these Terms, security concerns, legal requirements, or discontinuation of a Service. Where practical, we will provide notice. Termination does not erase obligations already incurred. Provisions that by their nature should continue, including intellectual property, disclaimers, and limitations of liability, survive termination. Information retained after closure is handled as described in the Privacy Policy.
12. Changes to the Services or Terms
We may update the Services and these Terms as products, practices, or requirements change. Updated Terms will be posted here with a revised date. We will provide additional notice or seek agreement when required by applicable law. Continued use after updated Terms take effect constitutes acceptance to the extent permitted by law.
